MEETING MINUTES – TUESDAY SEPTEMBER 23, 2008

McKinney advised the Board that FEMA has required a flood plain plan for every town before each can request FEMA aid.  McKinney, Steve Workman and Quinlan are working on a “flood plain ordinance” .  This must be placed on the warrant in March to be voted on by the people.  Imorlica said she would ask Angela Wilson, Administrative Assistant, for the schedule to enable passage of this item.

7:07 PM  Subdivision Regulations Hearing – Road Regulations   Imorlica opened the hearing and pointed out that the major changes were outlined in Table I of the hand-out.  Imorlica then asked for any comments from the audience.  Jay Wilson said that the degrading of the road requirements is a mistake.  Leaving the wider road widths in the ordinance lets the Board downgrade them if they feel it is reasonable to do so.    Imorlica pointed out that always changing the rules really means that no rules are in place.    Kenneth Spalding, III (Chip) pointed out that these new minimal road requirements are only applicable to new roads.  Arico said that along with road width the clearing on both sides gives the impression that the road is wider or narrower.  A 20’ pavement width plus 2’ clearing on either side gives a wide pathway.  Sean Mamone stated that roads under 20’ wide are visited by emergency vehicles more often than wider roads.  Jay Wilson added that wider roads give emergency personnel more room to work in therefore adding to their safety.  Imorlica pointed out that these regulations can be adopted by the Planning Board and do not need to be on the warrant in March.  She added that she wants to stress safety and feels the pavement should be wider.  Bird then moved to adopt the new Road Regulations as printed.   McKinney seconded the motion.  Bird, Quinlan, Arico, Bolinsky and McKinney voted yes and Imorlica voted no.  Motion passed.

 

7:35 PM  Scenic Road Hearing – Trow Road   Imorlica repeated Public Works Director, Bucky Grugnale’s intention to remove trees from the road side of the stone wall and will put the stone wall back to original condition when the road work is complete.  Public Works Department will put rip rap in the ditch to alleviate the washouts.  Cross culverts are not an option because the road is too hard to dig.  The work will be conducted from Mrs. Trow’s home down to Old Milford Road (south).  No work will take place from Mrs. Trow’s home to Old Wilton Road (north).  Written permission from Mrs. Trow will be obtained prior to start of work.  The work will commence in November depending on weather conditions.  Having no audience comments Imorlica declared the hearing closed at 7:40pm.

7:40 PM  Agenda Schedule was revised to let Fairhaven Condominiums, LLC go first as their presentation  is shortest.  Mr. Tom Carr with Meridian Land Services, Inc. as presenter for Greenway Valley Realty Trust had no objection.

7:42 PM Fairhaven Condominiums, LLC  Mr. Rolf K. Biggers presented a statement of “Drainage and Maintenance Easement”  pertaining to this project.  After minimal discussion Quinlan moved to accept the “Drainage and Maintenance Easement” as printed (copy attached).  Bird seconded the motion and it passed unanimously.  Imorlica and Arico will sign the final approval this week.

8:00 PM  Greenway Valley Realty Trust – 3-lot subdivision of Map 2 Lot 23 off Old Amherst Rd., Review for Approval, continued.  Mr. Tom Carr of Meridian  Land Services, Inc. handed out his response to a communication from Angela Wilson dated September 12, 2008 which listed 13 items of concern to the Planning Board.  Discussion of these items then ensued.   Carr stated that Board has been given a copy of the Amherst Fire Department approval letter.  In that letter they stipulated that these houses would be equipped with sprinkler systems (copy attached).  Letter from the Mont Vernon Conservation Commission will be submitted.   Bird questioned the length of the private way and Carr responded that the many vernal pools on the property necessitated that length.  Chip Spalding from the audience commented that the current private way is way under town road specs and ends in a hammerhead.  This means that it would need to be greatly updated to ever be accepted as a town road.  Mamone added that unpaved private roads can be problematic but that is builders decision.  Carr stated that Dearborn Way is the name given to this private way.  Mamone replied that for 911 concerns that name is very close to Deer Brook Way.  Carr agreed to changing the name.  #3:  silt fences – Carr will enter a note on the plans that silt fences will be installed as necessary.  #5:  granite markers – the Board agreed on granite markers rather than iron pins

Bird asked how conservation easement boundaries are marked.  Carr responded that they are pinned at every lot corner and tree blazed between pinnings.   Imorlica told Carr that the  Mont Vernon Conservation Easement for their parcel in the subdivision as well as well as the easement for the driveway entering from Old Amherst Road had not yet been received.  The driveway easement should measure 25’ from the center of the road.  This hearing will continue next month.

9:00 PM Imorlica announced that many potential zoning and subdivision changes are listed at the bottom of the Agenda.  Any Board member interested in pursuing one of these should notify her.

9:10 PM McKinney moved to adjourn the meeting.  Quinlan seconded the motion and it passed.
