Meeting called to order at 7:07 PM
Seated: Annette Immorlica, Don Gunter, Wes Sonner, Chip Spalding, Jim Bird – Chairperson, John Quinlan, the Selectmen's Representative. Quinlan arrived at 7:20
Planning Board noted that there has been no application for a scenic road hearing.
Also noted that the Zoning Board of Adjustment meeting of July 21st was cancelled due to lack of proper public notification. ZBA meeting is now scheduled for August 11, 2009.
7:15 PM Ken Clinton, of Meridian, representing Whitcomb and Gelbwaks and the Mont Vernon General Store and Bistro. He noted that all applications are filed. He noted that ZBA meeting was cancelled and now created delay. ZBA meeting is August 11th and will be held in the Fire Station Community Room.
Historic District was notified and will now be meeting on Friday July 31st. Concern was mentioned to 20 day rule for time of meeting. Mute point since the ZBA meeting was postponed. Spalding and Gunter will attend representing the Planning Board.
Clinton asked of boundaries of property. He said that he relied on the Bob Todd Plan of 1977. Plan is recorded at the NH Registry of Deeds. The Plan is not correct with regard to boundaries and right of way on RT 13, and setbacks. Discussion of width of road being 3 rod wide, (16 ½ feet per rod. Road width should be 4 rods. Stone wall found in boundaries and sideline width are off by a rod. Reasonable right of way was discussed. Setbacks should be 8 feet further back. A search of the road width for Beech Hill Road and Blood Road shows there is no layout for this as per Meridian and the State DOT.
Gunter asked what is the width of Blood Road, and Clinton responded it is 33 feet or 2 rods. It was also noted that RT 13 was put in after Francestown Tpke.
Bird asked what roads are considered frontage for the store. Clinton said all roads are frontage roads. Clinton also stated that no area variances are needed.
Bird asked that Clinton contact Keith Pomeroy for a history of town roads and town road files. Clinton said he would do that.
It was also stated that no setback variance are needed.
Immorlica asked if the Smith property has been survey. Clinton stated it has not.
There was further discussion of setbacks and boundaries.
Gunter asked if the plan was correct, and Clinton said all plans are correct.
The traffic situation was then discussed.
A traffic study was completed in 2006. It was noted that a general rule is the plan is used for 5 years, but have been know to use the plans for 7 to 10 years. The Traffic Project Report was done by
NRPC. It was noted that the traffic is graded, C – being an average grade. The intersection of Francestown Tpke and RT 13 is a B grade in the morning. And an A grade in the afternoon. Is was stated that there are no problems as it exists now. With the build out of property, approximately 20 cars at most will be there. Therefore traffic flow from the current A-B grade to C-B grade when the store is complete is no change. Perception of traffic vs. reality of traffic was discussed. Also noted that the traffic using roads through Mont Vernon are not necessarily residents of Mont Venon. Clinton stated that the report is close to accurate by today's standards.
Regarding Francestown Tpk and Beech Hill Road, Sonner stated that the existing traffic is not a relevant issue. Gunter stated the number of cars at 6:30 in the morning is an issue, but Clinton said even with the increase in traffic it would still not be an issue.
Spalding inquired about a curb cut on Francestown Tpke, and were corrected boundaries submitted to the state. Clinton noted that the DOT does not need a survery.
Bird inquired about truck parking issues. Clinton stated that he was not in favor of accommodating truckers and advised Whitcomb/Gelbwaks of that.
Clinton said that Dot Smith has been consulted about the road in front of her house.
State would have jurisdiction of Beech Hill Road, Rt 13.
Immorlica said that a “Sale Pending” sign is on the property in question and asked Clinton what he knew of that. Clinton said, that it was his guess that the Purchase and Sale agreement is pending approval from the town.
Discussion of a right of way was made regarding a sidewalk and crosswalk from Francestown Tpke to the store.
Bill Quinn, resident of Beech Hill Road asked about the road improvement of Beech Hill Road. Quinlan stated that the town would require the road to be upgraded.
Clinton noted that they have not met with Selectmen, Highway Dept and Fire Dept yet.
At 7:50 PM Clinton asked that he be continued for the next meeting.
Bird questioned email sent to ZBA and response. It was noted that the response was non-committal.
Quinlan stated that the concerns of the Historic District Commission is that of appearance and fitting into the community.
Bird stated that Commercial zoning in town is an issue. Commercial zoning by variance an special exception.
Immorlica brought up the ZBA meeting of August 11th. Bird suggested that the PB meeting adjourn and attend the ZBA meeting. Immorlica thought that was confrontational. Gunter noted we are separate from ZBA. Immorlica suggested cancelling the Planning Board meeting. Quinlan suggested that one representative and the Chairperson attend the meeting.
Immorlica made a motion to cancel the meeting of August 11th, seconded by Quinlan. Discussion of cancelling meeting, rights of citizenship were also brought up. Cooperation of boards, PB and ZBA , also an issue. Angela will send an email asking ZBA to keep us informed of events of August 11th meeting.
Immorlica, Quinlan, Sonner, Spalding, and Bird in favor of canceling PB meeting of August 11th. Spalding opposed.
8:10 PM minutes of last meeting
Immorlica motions to accept minutes, Gunter seconds, minutes approved by all. Spalding, Bird and Quinlan abstain.
8:15 PM Scenic road issue discussed.
8:20 PM Spalding asked that Planning Board email Historic District Commission and the ZBA of their upcoming meetings and their outcomes. PB will ask chairpersons of each group and committee to inform PB of upcoming meetings
8:25 PM Immorlica motions to adjourn, Sonner 2nds. All in favor of adjournment.
